Logan Health agreed to pay $4.3 million to resolve claims it failed to prevent a 2021 data breach that compromised patient information.
The settlement benefits individuals who were notified by direct notice and publication that their personal information may have been compromised in the November 2021 data security incident disclosed by Logan Health on Feb. 18, 2022.
Plaintiffs in the Logan Health data breach class action lawsuit accused the health system of failing to protect consumers from a 2021 data breach. According to the plaintiffs, reasonable cybersecurity measures could have prevented the breach.
Logan Health — a Montana health center — disclosed the breach in February 2022. The breach compromised names, contact information, dates of birth, sensitive health information, insurance data and more.
Logan Health hasn’t admitted any wrongdoing but agreed to a $4.3 million class action settlement to resolve these allegations.
Under the terms of the settlement, class members can receive reimbursement for out-of-pocket expenses related to the data breach. The settlement allows consumers to claim up to $25,000 in out-of-pocket expenses and up to $125 for lost time.
Class members can also receive additional benefits in the form of free credit monitoring or an alternative cash payment.
Class members who opt into receiving credit monitoring will receive three years of free services.
Class members who choose to receive an alternative cash payment will not receive credit monitoring. Cash payment amounts will vary depending on the number of participating class members and other factors.
The deadline for exclusion and objection is Feb. 13, 2023.
The final approval hearing for the settlement is scheduled for March 9, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by April 3, 2023.
