Claire’s data breach $350K class action settlement

Claire’s has agreed to pay $350,000 to resolve claims it mismanaged a 2020 data breach that compromised sensitive consumer information.

The settlement benefits consumers whose personal information may have been compromised in the Claire’s data breach between April 7 and June 17, 2020.

Claire’s is an accessories store with locations seen in malls around the country. In 2020, the store was subject to a data breach for at least seven weeks.

According to Bank Info Security, hackers infiltrated Claire’s systems through its Salesforce cloud. Through this access, third parties were reportedly able to insert a code onto Claire’s e-commerce platform that allowed hackers to steal payment card data.

Consumers quickly took legal action against the retailer, arguing that the company should have prevented the breach.



Plaintiffs in a data breach class action lawsuit claim Claire’s also mishandled the breach by failing to identify and resolve the threat in a timely fashion. As a result of the company’s alleged negligence, consumers could have unknowingly had their payment information stolen for weeks, the class action lawsuit contends.

One plaintiff in the case says she suffered more than $700 in fraudulent charges after hackers stole her information in the Claire’s data breach. Another plaintiff says while he hasn’t been the subject of fraud, he has been overwhelmed with phishing emails as a result of his stolen data.

Claire’s hasn’t admitted any wrongdoing but agreed to resolve these allegations with a fund of up to $350,000. This amount will be solely used to pay consumer claims, additional payments from the company will cover attorneys’ fees, administration expenses and other costs.

Under the terms of the Claire’s settlement, class members can collect payments for expense reimbursement and extraordinary expense reimbursement.

Expense reimbursement payments include compensation for bank fees, interest, postage and mileage, up to three hours of lost time at a rate of $19 per hour, $19 for each card that had fraudulent charges reimbursed, and up to $50 for credit monitoring and identity theft protection purchased as a result of the breach. Expense reimbursement is capped at $250 per class member.



Extraordinary expense reimbursement payments compensate for unreimbursed monetary losses that occurred as a result of the data breach. This includes unreimbursed fraudulent charges and identity theft expenses. Extraordinary expense reimbursement is capped at $3,000 per claimant.

Class members can also receive one free year of Experian’s IdentityWorks identity protection services. A link and redeemable code was sent to each class member with their settlement notice.

The deadline for exclusion and objection is Aug. 25, 2022.

The final approval hearing for the Claire’s settlement is scheduled for Sept. 27, 2022.

In order to receive a payment from the settlement, class members must submit a valid claim form by Sept. 24, 2022.
